These terms apply when you use frogmedia.ca, hire FrogMedia, a division of The Graphic Zone (together, “FrogMedia”, “we”, “us”), of Okotoks, Alberta, Canada, or use a website or online ordering system that FrogMedia builds and runs for one of our client businesses. By using these websites or services you agree to these terms. Please also read our Privacy Policy.
Our services
FrogMedia provides design, printing, apparel, signage, websites and online ordering. Quotes describe the work, price and timing for a specific project. A project starts once you accept the quote, and any deposit or payment terms written in your quote or invoice apply to that project.
Your artwork and content
When you send us logos, artwork, photos or text, you confirm that you own them or have permission to use them, and that they do not break anyone else’s rights or the law. You keep ownership of your content and give us permission to use it to complete your work. We may refuse content that we believe is unlawful, offensive or infringing.
Proofs and approvals
For printed and custom items we may send a proof. Please check it carefully: once you approve it, we produce the work as approved, and errors in an approved proof are your responsibility. Colours can vary slightly between screens and materials.
Ordering from a business through a website we run
When you place an order on a website FrogMedia runs for a business (for example a restaurant), your order is with that business. The business sets its own menu, prices, hours, delivery areas, and refund and cancellation decisions, and is responsible for preparing and delivering your order. FrogMedia provides the website and ordering technology on their behalf.
- Prices, taxes, delivery fees, discounts and rewards points are shown at checkout before you place your order.
- Coupons and rewards points have the conditions shown with them, have no cash value and may end at any time.
- Order times are estimates. The business may contact you or cancel an order it cannot fill.
Payments
Card payments are processed securely by Stripe. Payments for orders go to the business you ordered from. If an order paid by card is cancelled, the payment is refunded to the same card; refunds can take several business days to appear. For pay-at-pickup or pay-at-the-door orders, you pay the business directly.
Accounts
If you create an account, keep your sign-in details private and tell us or the business if you think someone else has used your account. We may suspend accounts that are misused.
Acceptable use
Please don’t misuse our websites: no attempts to break in, overload or interfere with them, no fake orders, and no use of someone else’s card or account.
Our content
The design, text, images and software of our websites belong to The Graphic Zone (FrogMedia) or our clients and may not be copied without permission, except for normal personal use of the site.
Limits of our responsibility
We work hard to keep our websites accurate and available, but they are provided “as is” and may sometimes be unavailable or contain errors. To the extent the law allows, FrogMedia is not responsible for indirect or consequential losses, and our total responsibility for any claim about our services is limited to the amount you paid FrogMedia for the service involved. Nothing in these terms limits rights you have under consumer protection law.
Governing law
These terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there.
Changes
We may update these terms from time to time. The date at the top shows when they last changed.
